new.gif (130 bytes)Due to recent changes in Utah law, and subject to exceptions noted below, the regulation of closed end residential first mortgage lending and brokering is now under the jurisdiction Utah's Department of Commerce, Division of Real Estate.  Those entities regulated by the Division of Real Estate are no longer required to provide notification to the Department of Financial Institutions unless they are depository institutions or their affiliates, or servicers of mortgage loans.

The following fall under the jurisdiction of the Department of Financial Institutions and do need to maintain a Residential First Mortgage Notification Form with the Department.

  • Entities servicing closed end residential first mortgages on Utah properties.
  • Depository institutions (as defined under Utah Law) or affiliate of such.

If you broker or lend on residential 1st mortgages in Utah, and you are not a depository institution or affiliate thereof, you should register with the Utah Department of Commerce: Real Estate Division at (801) 530-6747.

Filing instructions are included on the notification form.  If you wish to engage in Residential First Mortgage activities with Utah Citizens, complete the form and return it with the appropriate fee.
